General Terms and Conditions

Sect. 1 Scope of validity, customer information

The following General Terms and Conditions (GTC) govern the contractual relationship between Internet Solutions Timo Reith (getasa2.com) and consumers and entrepreneurs who purchase goods in our shop. Conditions that oppose or differ from our terms and conditions are not accepted by us. The contract language is German.

Sect. 2 Conclusion of contract

(1) The offers on the Internet represent a binding invitation to you to purchase goods.

(2) You can put one or more products into the cart. In the course of the order process you enter your data and desires concerning payment method etc. Once you have entered your information and clicked the order button, you submit a binding offer to conclude a purchase contract. The products will then be made available for immediate download.

Sect. 3 No time limit

After the purchase of a product, there is no time limit during which the product must be downloaded. Once the product is made available to you, you can use your customer login at any time to access the link to download the product.

Sect. 4 Number of downloads

The number of downloads is not limited.

Sect. 5 Licensing

Licenses are valid for one year from the date of purchase. A valid and active license key is required in order to get updates and support for our software. After one year, license keys may be renewed at a 30% discount from the purchase price of a new license. You must keep your license key secret. You may not distribute, give away, lend or re-sell it. We reserve the right to monitor levels of your key usage activity and take any necessary action in the event of abnormal usage being detected.

After you have purchased a license for our software, you are licensed to install the software only into the number of websites corresponding to the license you purchased.

We provide three kinds of commercial licenses for our software ASA 2:

Personal: You may install the plugin on one website for your personal and commercial use. You may not redistribute the plugin in any forms, including but not limited to templates, themes, software and applications. This license includes updates and support for 1 year. This license is compatible with WordPress multisite installations.

Professional: You may install the plugin on five websites for your personal and commercial use. You may not redistribute the plugin in any forms, including but not limited to templates, themes, software and applications. This license includes updates and support for 1 year. This license is compatible with WordPress multisite installations.

Business: You may install the plugin on 25 websites for your personal and commercial use. You may not redistribute the plugin in any forms, including but not limited to templates, themes, software and applications. This license includes updates and support for 1 year. This license is compatible with WordPress multisite installations.

Sect. 6 Software Updates

Updates are included for free for one year. If you have a valid and active license key, you can update the plugin in your WordPress dashboard. Alternatively, updates can be downloaded from your account page (https://getasa2.com/your-account/).

WordPress automatically checks for updates to its core and all installed themes and plugins. When doing update checks, our software will connect to https://getasa2.com/ and check for update information.

Sect. 7 Support Services

Support for our software is given up to one year after the purchase date. If you wish to get support after one year, you must renew your license key or purchase custom priority support access.

Sect. 8 Copyright

The Software is owned by Internet Solutions Timo Reith and is protected by German and European Union copyright laws and international treaty provisions. Therefore you must treat the software like any other copyrighted material (e.g., a book or musical recording) except that you may either:

(a) make one copy of the software solely for backup archival purposes;
or (b) transfer the software to a single hard disk provided you keep the original copy solely for backup or archival purposes.

You may not copy written materials accompanying the software without the prior written agreement of Internet Solutions Timo Reith.

Sect. 9 Private copies

You are permitted to make private copies for your own personal use on other forms of media.

Sect. 10 Customer information: Storage of the contractual text

The contract with the item details (e.g. kind of product, price) will be stored by us. The GTC we send to you too, you can call the GTC at any time in addition, over our web page. As registered customer you can access your passed orders over the customer login range (https://getasa2.com/your-account/).

Sect. 11 Customer information: Correction Note

You can amend your entries at any time before submitting the order by using the delete key. We will keep you informed throughout the checkout process of further correction options. You can terminate the order process also at any time by closing of the browser window completely.

Sect. 12 Statutory warranty rights

The warranty complies with the statutory provisions.

Sect. 13 Limitation of liability

We exclude liability for minor negligence in breach of duty, provided such breaches do not involve essential contractual obligations, damages caused by death, bodily injury, impaired health or guarantees or affect claims under the Produkthaftungsgesetz (ProdHaftG, Product Liability Act). Same is valid for obligation injuries of our executing aides and our legal representatives. Belonged to the contract-substantial obligations in particular the obligation to hand over and for you the property to it provide to you the thing. Further we have to provide the thing for you freely from special and defective titles to.

In particular, our software is not liable for fulfilling the Amazon Associates Program Operating Agreement automatically. It is the responsibility of the consumer to fulfill the Amazon Associates Program Operating Agreement.

IN NO EVENT SHALL Internet Solutions Timo Reith BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF THE SOFTWARE, EVEN IF Internet Solutions Timo Reith HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALL LEGAL ISSUE SHOULD BE JUDGED BY THE COURT INDICATED BY Internet Solutions Timo Reith.

Sect. 14 LIMITED WARRANTY

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL THE AUTHOR or AUTHORS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US, SUPERSEDING ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS LICENSE.
